What is Age Discrimination?

Age discrimination involves treating an applicant or employee less favorably because of his or her age. It is one of the new form of discrimination where discrimination is based on the age of the person. This concept is seen in the industry sector where merit is not the criteria but age is.

Direct age discrimination happens when someone is treated unfavourably because of their age.

 

Indirect age discrimination happens when a requirement, condition or practice is imposed that disadvantages a person or group because of their age, and is not reasonable.

The laws in United States are clear and prohibit discrimination in job, appointment or any such opportunities based on age. The Age Discrimination Act of 1975 prohibits any discrimination based on age in programs and activities that get federal aid and assistance. The Act applies to all ages and permits certain age distinction and factors other than age that matches Act’s requirements.

Age Discrimination & Work Situations :

Age Discrimination in Employment Act of 1967 (ADEA) protects certain applicants and employees 40 years of age and older from being discriminated on the grounds of age in getting promotion, increment, compensation, discharge of duty, etc.

Section 188 of the Workforce Investment Act of 1998 (WIA) prohibits discrimination against applicants, employees and participants in WIA Title I-financially assisted programs and activities, and programs that are part of the One-Stop system, on the grounds of age. In addition, WIA prohibits discrimination on the grounds of race, color, religion, sex, national origin, disability, political affiliation or belief, and for beneficiaries only, citizenship or participation in a WIA Title I-financially assisted program or activity.

Age Discrimination Law Explained:

Discrimination based on your age may be allowed in the following circumstances:

  • the eligible age to vote or drink alcohol at licensed premises being restricted to adults aged 18 years and over
  • hostel accommodation established for the welfare of a particular age group being limited to catering to that age group
  • benefits, such as discounted cinema tickets targeting a specific age group, for example, people over 65 years
  • participation in an education program or attendance at a school being restricted to particular age groups
  • participation in a sporting activity being limited to a specified age or age group, for example, a basketball team for people under 19
  • clubs restricting membership or benefits to particular age groups
  • laws restricting alcohol consumption and sale, and the purchase of cigarettes, to people over a specified age
